System Benefits
The State Construction Registry (SCR) provides subcontractors and suppliers with a simple and standardized way to protect lien rights and insure payments for goods or services are received in a timely manner. By filing a preliminary notice through the SCR system, subcontractors and suppliers can alert property owners and general contractors to their involvement in a project and expectation of payment. The State Construction Registry provides participating subcontractors and suppliers with project visibility and will help general contractors oversee that payments trickle down to the appropriate parties.
The SCR system also helps keep subcontractors and suppliers informed by providing automated email notifications when additional preliminary notices or Notices of Completion are filed on any of their projects. Automated notification of the Notice of Completion is important because it notifies subcontractors and suppliers that they have 90 days or less to file a lien if they haven't been paid.
Filing Details & Tips
Preliminary Notices
- Unless contracting directly with a property owner, all subcontractors and suppliers providing services, materials and / or equipment must file a preliminary notice to preserve lien rights (assuming a Notice of Commencement is filed in a timely manner within the SCR system).
- Preliminary notices must be filed 20 days after the filing of the notice of commencement OR 20 days after furnishing labor, service, material and/or equipment, whichever comes later.
- Preliminary notices must be filed through the SCR system; certified letters to the general contractor will not preserve lien rights.
Notices of Commencement
As of May 1st, 2006, subcontractors and suppliers are no longer able to file Notices of Commencement. Only original contractors and property owners (in addition to municipalities) are able to file Notices of Commencement.
Amendments
- Any party that has associated themselves with a project (by filing some form of notice) can file an amendment to the project. Amendments are filed by clicking the "New Amendment" button found on the Filing Detail page of each project.
- Amendments are appended to a project and therefore the data contained in the original Notice of Commencement is never overwritten.
